Please read these Terms and Conditions ("Terms") carefully before using the DJAZ mobile application (the "App") and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Acceptance of Terms

By accessing and using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you do not agree to these terms, you are not permitted to use this Service.

2. Description of Service

DJAZ provides a platform that enables users to:

  1. Create and customize bio link pages
  2. Shorten URLs
  3. Host static websites
  4. Generate file links, Vcard links, and event links
  5. Utilize splash pages
  6. Categorize resources using projects
  7. Create links that automatically open apps
  8. Track link analytics
  9. Integrate with pixel providers (Facebook, Google Analytics, etc.)
  10. Access web utility tools (checker, text, converter, generator, developer, image manipulation, time converter, miscellaneous)
  11. Use AI systems for document generation (dependent on plan)

3. User Accounts

  1. Users may need to create an account to access certain features of the Service.
  2. You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your device.
  3. You agree to accept responsibility for all activities that occur under your account.
  4. You must provide accurate and complete information during the registration process.

4. Usage and Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others. You agree not to:

  1. Use the Service to promote illegal activities or content that is offensive, harmful, or violates any applicable laws or regulations.
  2. Attempt to gain unauthorized access to the Service or related systems or networks.
  3. Interfere with the proper functioning of the Service.
  4. Use the Service for spam or to distribute unsolicited messages.
  5. Use automated means to access the Service or collect information.
  6. Transmit viruses, worms, or other harmful code through the Service.
  7. Violate any intellectual property rights of DJAZ or third parties.

5. Intellectual Property

  1. The Service and all of its content (including software, design, trademarks, logos, text, graphics, etc.) are owned by DJAZ or its licensors and are protected by copyright and other intellectual property laws.
  2. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
  3. You agree not to copy, modify, distribute, sell, or create derivative works based on the Service or its content without the express written permission of DJAZ .

6. Free Plan and Paid Plans

DJAZ offers a free plan, and paid plan with specific features.

  1. Free Plan: The Free Plan includes unlimited use of all listed features including, bio link pages, bio link blocks, payment processors, shortened links, file links, vcard links, event links, static sites, projects, splash pages, pixels, with ads, without custom domains, limited AI functionality (0 documents, words, images, transcriptions, chats, messages), and limited statistics retention.
  2. Custom Plan: The Custom Plan includes unlimited use of all listed features including, bio link pages, bio link blocks, payment processors, shortened links, file links, vcard links, event links, static sites, AI functionality ( unlimited documents, words, images, transcriptions, chats, messages), email signatures, projects, splash pages, pixels, unlimited statistics retention, and includes, custom back-half, deep linking, removable branding, custom branding, dofollow links, leap link, SEO features, additional fonts, custom CSS, custom JS, in-depth statistics, link scheduling and limiter, cloaking short URLs, auto open app on mobile, UTM parameters, password protection, sensitive content, no ads, and white labeling
  3. Changes in Features: DJAZ reserves the right to modify or discontinue features for any plan at any time.

7. AI Services

  1. AI document, text, image, and transcription generation is provided as part of the Custom plan, and with limitations in the Free plan.
  2. We do not guarantee specific outcomes or accuracy of AI generated content.
  3. You are responsible for the content created through AI systems and your use of it.
  4. You acknowledge that all AI systems are continuously evolving and improving.

8. Analytics and Tracking

  1. The service provides built-in analytics.
  2. You can track a variety of metrics.
  3. The service integrates with tracking pixels.
  4. We adhere to GDPR, CCPA and PECR regulations.

9. Third Party Services

  1. The Service may integrate with third party services.
  2. You acknowledge that your use of these services is subject to their respective terms and conditions.
  3. DJAZ is not responsible for the content, accuracy or practices of these third party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. DJAZ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DJAZ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DJAZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT; OR (F) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless DJAZ , its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

13. Changes to the Terms

DJAZ reserves the right to modify these Terms at any time. Any changes will be posted on the Service. Your continued use of the Service following such modifications will be deemed your acceptance of the updated Terms. It is your responsibility to check for updates regularly.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws , without regard to its conflict of law principles.
